Second Amendment Law to the Television and Radio Broadcasting Law

State Administration Council Law No 63/2021

THE State Administration Council hereby enacted this law under Section 419 of the Constitution of the Republic of the Union of Myanmar.

1. This law shall be called the Second Amendment Law to the Television and

Radio Broadcasting Law.

2. Section 2 (a) of the Television and Radio Broadcasting Law shall be sub

stituted as follow:-

“(a) Television and Radio Broadcasting means the broadcastingvia ground-based TV and radio transmission stations, underground and above ground cable links and satellite or anyother technology for the people to directly catch the televisionand radio programmes.”

3. The phrase “ the fine ranging from K30 million to K50 million” includedin Section 96 of the Television and Radio Broadcasting Law shall be substituted with the phrase “the imprisonment from three years’ in minimumto five years’ in maximum or the fine from K30 million in minimum to K50million in maximum or both”.

4. The phrase “ the fine ranging from K5 million to K10 million” included inSection 97 of the Television and Radio Broadcasting Law shall be substitutedwith the phrase “the imprisonment from six months’ in minimum to oneyear’s in maximum or the fine from K5 million in minimum to K10 millionin maximum or both”.

5. The phrase “ the fine ranging from K10 million to K30 million” includedin Section 98 of the Television and Radio Broadcasting Law shall be substituted with the phrase “the imprisonment from one year in minimum tothree years’ in maximum or the fine from K10 million in minimum to K30million in maximum or both”.

6. The phrase “ the fine ranging from K30 million to K50 million” included inSection 99 of the Television and Radio Broadcasting Law shall be substituted with the phrase “the imprisonment from three years’ in minimumto five years’ in maximum or the fine from K30 million in minimum to K50million in maximum or both”.7. The following section shall be inserted as Section 99-a, under Section 99 ofthe Television and Radio Broadcasting Law:-“99-a: If anyone shall be sentenced for failure to follow or forbreaching bylaw, rules, discipline, notification, order, directiveor any item of procedure released in accord with the Section106, one year’s imprisonment in minimum to five years’ imprison ment or K10 millions of fine in minimum to K50 millions inmaximum shall be sentenced to the person and the materialsrelated to the case shall be confiscated as public finance.”

8. The following section shall be inserted as Section 105-a, under Section

105 of the Television and Radio Broadcasting Law:-“105-a: Offences in this law shall be identified as cognizable offences.”I hereby signed this law under Section 419 of the Constitution.
