1.Civil service personnel are well operating the whole State machinery. However, political and economic systems and governments were changed, and civil service personnel have to manage the State machinery alive constantly. Some of them were taken action under the provisions of the Civil Service Personnel Law and rules for failures in service personnel code of conduct, breaking disciplines and ab-sence in duty, and some personnel were taken action under the law for their acts or criminal commitments based on their lack of responsibility.
2.Some service personnel of those taken actions participated in the CDM activities intending to undermine the State. Some service personnel were also taken action to participate in the CDM activity for utilizing their emotional moods, pressure, threats and coercion by those from their environs, worries for suffering social punishment that can discredit the human prestige and concerns for unexpected situations.
3.Some civil service personnel taken action for participation in the CDM activities did not take part in the riots and terrorist acts. If they submit the report to redischarge duty as civil service personnel as they participated in the activities for one of the above-mentioned reasons, taking action against them will be lifted under the criminal process based on the following facts.
(a)recommendations of theheads of relevant service organizations that those service personnel were satisfied with their past duty assignments and they would be appropriate for more assignments
(b)remarks and recommendations of relevant region administrative bodies and prosecution organizations for whether educating and warning those service personnel for writing and expression on the social networks can be controlled continuously or not and whether they participated in the riots and terror acts
(c)the promise of those service personnel
4.By reviewing the action taken against those service personnel, arrangements will be made as follows:
(a) as those departmental personnel taken action under the Civil Service Personnel Law have the rights to appeal their cases within six months, they will be allowed to discharge State duty by easing the punishment depending on further scrutiny because they can continuously contribute to nation-build-ing tasks
(b)Action taken againstthe personnel under Section 505 (a) or 505-a of the Criminal Procedure for their activities and absence amounting to crime will be withdrawn, and punishment will be eased under the Civil Service Personnel Rules so as to allow them to discharge State duties5. As such, information was re-leased that it is necessary to consider the civil service personnel who were taken action for participation in the CDM activities due to suffering from utilization over sensitive emotion, pressure, threats and coercion from environs, worries for facing social punishment and other unexpected situation to be able to redischarge State duties.
